Eli Lilly Fires Off Another Cymbalta Patent Suit

Law360 (December 5, 2008, 12:00 AM EST) -- Eli Lilly and Co. has continued its effort to stop generic-drug companies from marketing copycat versions of the antidepressant Cymbalta, shooting off a patent infringement suit against India-based Sun Pharmaceutical Industries Ltd.

The suit, filed Thursday in the U.S. District Court for the Southern District of Indiana, marks at least the eighth time since the middle of November that Eli Lilly has brought litigation against generic-drug makers over Cymbalta.

The other companies that have been sued are: Aurobindo Pharma Ltd., Lupin Ltd., Sandoz Inc., Impax Laboratories...
