Judge Tosses Sick Leave Suit Against Wells Fargo

Law360, New York (December 5, 2008, 12:00 AM EST) -- An Oregon state appeals court has upheld the dismissal of a proposed class action against Wells Fargo & Co. for allegedly violating employees' contracts by wiping out their accrued unused sick leave after merging with Norwest Corp.

Judge David Schuman, writing for a three-judge panel of the Court of Appeals for the State of Oregon, ruled Wednesday that Wells Fargo employees were not entitled to use their accrued unused sick time after the 1998 merger replaced their contract, because of the terms of the original contract....
