Plaintiffs Fight Apple Over Added Filing On IPod Class

Law360 (December 5, 2008, 12:00 AM EST) -- Plaintiffs in the consolidated antitrust class action against Apple Inc. are fighting the company's bid to file additional briefing over the motion for class certification of iPod owners, arguing that with a hearing fast-approaching, the request is too late.

Less than two weeks before the court's scheduled hearing on the motion to certify a class of consumers who purchased iPods, Apple attempted to present “redundant merits” arguments by contending that the plaintiffs had put forward new arguments.
