Plaintiff Seeks To Revive FCA Suit V. Express Scripts

Law360, New York (December 8, 2008, 12:00 AM EST) -- A former pharmacist at the mail-order pharmacy Express Scripts Inc. is asking a federal court to reconsider its decision to dismiss his False Claims Act qui tam case, saying his complaint did in fact include allegations that the court said were lacking.

In an order issued Dec. 1, Judge John P. Fullam of the U.S. District Court for the Eastern District of Pennsylvania ruled that former employee Charles Lobel had failed to state a cause of action under the FCA and dismissed the complaint.
