Healogics Shakes Whistleblowing Doctors' FCA Suit

Law360, New York (May 12, 2016, 2:57 PM EDT) -- A Florida federal judge tossed a False Claims Act suit alleging wound treatment provider Healogics Inc. instructed its doctors to upcode or do unnecessary procedures in a scheme to overbill government-funded health care programs, concluding Wednesday the whistleblowers' allegations were too vague.

Former Healogics doctors Benjamin A. Van Raalte, Michael J. Cascio and John J. Murtaugh did not identify particular instances wherein their colleagues were successfully influenced to alter a patient's treatment and submit a false claim, U.S. District Judge Gregory A. Presnell said, determining the whistleblowers failed to state a claim but giving them leave to amend their suit....
