2nd Circ. Upholds 3.5-Year Term For Ex-Impath Exec

Law360 (December 9, 2008, 12:00 AM EST) -- An appeals court has upheld a 3.5-year prison sentence for a former Impath Inc. executive convicted of securities fraud in 2006 despite arguments from federal prosecutors that the prison term was too short.

The U.S. Court of Appeals for the Second Circuit on Tuesday ruled the district court had used its discretion appropriately in sentencing former Impath President Richard P. Adelson, who is serving time in federal prison for conspiracy, securities fraud and filing false statements with the U.S. Securities and Exchange Commission.
