Class Gets OK In FLSA Suit Against Phillips Oil

Law360, New York (December 11, 2008, 12:00 AM EST) -- A federal judge in Florida has conditionally certified a class of convenience store assistant managers in a suit to collect overtime wages from their employer, Phillips Oil Inc., but refused to toll a statute of limitations to allow additional opt-ins to join the case, saying the plaintiffs failed to identify any extraordinary circumstances.
