Altria Sues FDA Over 'Black & Mild' Cigar Ban

Law360, New York (May 27, 2016, 4:08 PM EDT) -- Altria Group is suing the U.S. Food and Drug Administration over an expansion of anti-tobacco powers, arguing in D.C. federal court that the agency’s approach would improperly ban its popular Black & Mild brand of cigars.

In a complaint filed on Thursday, Altria accused the FDA of flouting the plain text of the Tobacco Control Act this month when it extended limits on cigarette marketing to cigars and pipe tobacco, among other products.
