Judge Denies Compuware Request for Preliminary Injunction Vs. IBM

Law360 (January 20, 2004, 12:00 AM EST) -- A U.S. District Judge has denied Compuware’s request for a preliminary injunction to bar IBM from selling software that the Michigan software maker says infringes its copyrights and is based on stolen trade secrets.

In his ruling, Judge George Caram Steeh of the U.S. District Court for the Eastern District of Michigan wrote that Compuware has failed to prove that IBM stole trade secrets and has failed to establish that IBM's advertising deceived customers.
