Judge Denies Summary Judgment Vs. P&E

Law360, New York (January 20, 2004, 12:00 AM EST) -- A New York Supreme Court Justice denied summary judgment in Pfizer’s lawsuit against defunct intellectual property boutique Pennie & Edmonds, but ruled the firm had broken disciplinary rules and reported it to the Disciplinary Committee.

Pfizer had sued Pennie & Edmonds over its simultaneous representation of Pfizer and the University of Rockefeller, which both had an interest in patents for anti-inflammatory drugs known as COX-2 inhibitors. The drug maker claims the simultaneous representation constituted a breach of fiduciary duties and breach of disciplinary rules.
