10th Circ. Says Financial Co. Can't Block Tribe's Claims Yet

By Christine Powell (June 7, 2016, 10:37 PM EDT) -- The Tenth Circuit said Monday that an investment advisory services company could not yet invoke federal jurisdiction to prevent the Sac and Fox Nation from pursuing claims against it in tribal court over an allegedly breached contract.

In an unpublished opinion, a three-judge panel found United Planners Financial Services of America LP had not exhausted its tribal court remedies before asking a federal district court to intervene and enjoin the nation's tribal court lawsuit against it. The panel therefore affirmed the district court's dismissal of the suit based on the conclusion that United Planners cannot invoke federal jurisdiction.
