Rockwell Can't Cut Retiree Health Benefits: 6th Circ.

Law360, New York (December 16, 2008, 12:00 AM EST) -- An appeals court gave thousands of auto industry retirees a lift Tuesday, affirming a lower court’s view that auto parts manufacturer Rockwell International Corp. is obligated to provide lifetime health care benefits to former employees and their spouses.

The U.S. Court of Appeals for the Sixth Circuit upheld the trial court decision, scuttling an attempt by Rockwell and ArvinMeritor, the more recent embodiment of its automotive division, to scale back, and later discontinue, medical coverage to approximately 2,900 former workers in 12 plants the company shuttered...
