Fed. Circ. Rejects Appeal Of Anti-Dumping Rule

Law360 (December 16, 2008, 12:00 AM EST) -- The U.S. Court of Appeals for the Federal Circuit on Tuesday denied a bid by four Japan-based ball bearing makers to remand in light of a World Trade Organization ruling a Department of Commerce decision on anti-dumping duties and "zeroing."

Following in line with its August ruling on another group of foreign ball bearing manufacturers' challenge, the Federal Circuit again affirmed the Commerce Department's new model-match methodology for calculating anti-dumping duties and its use of “zeroing.”
