11th Circ. Affirms $35.5M Family Dollar OT Verdict

Law360, New York (December 17, 2008, 12:00 AM EST) -- A federal appeals court has upheld a $35.5 million verdict against discount retailer Family Dollar Stores Inc. in a class action suit that accused the company of failing to pay overtime wages to managers.

A panel of three judges in the U.S. Court of Appeals for the Eleventh Circuit ruled on Tuesday that the district court had not erred in awarding millions of dollars in unpaid wages to the opt-in class of 1,424 store managers, despite Family Dollar’s objections that store managers were exempt as executives....
