Char-Broil Fires Up Grill Antitrust Case Against Weber

Law360, New York (June 15, 2016, 2:19 PM EDT) -- Char-Broil LLC on Tuesday hit back against trademark infringement suits filed against it by Weber-Stephen Products LLC, telling a Georgia federal court Weber has abused its monopoly power to stymie competition in the charcoal grill market.

Weber's suits, filed in an Illinois federal court in March and April, violate an agreement the two companies made in the 1970s that each could continue making kettle-style grills, Char-Broil said in its complaint.

Weber has also engaged in anti-competitive conduct by misleading the U.S. Patent and Trademark Office, attempting to enforce fraudulent trademarks and pursuing baseless litigation to enforce those trademarks, Char-Broil said....
