Law360, New York (June 23, 2016, 11:17 AM EDT) -- Under long-standing provisions of the California Rules of Court, a published appellate opinion is automatically depublished when the California Supreme Court grants review in a case, meaning that the Court of Appeal opinion can no longer be cited as precedent, even for propositions as to which the Supreme Court did not grant review. Although the California Supreme Court has the power to order a Court of Appeal opinion republished, in whole or in part, after granting review, it has invoked that power on only a handful of occasions....
