ITC Ruling On Duties Affirmed In OJ Anti-Dumping Suit

Law360 (December 18, 2008, 12:00 AM EST) -- In a win for Brazilian orange juice makers, a federal appellate court said the U.S. Department of Commerce was entitled to supply its own reasonable interpretation when calculating anti-dumping duties.

A three-judge panel of the U.S. Court of Appeals for the Federal Circuit said Thursday that the DOC reasonably interpreted language allowing for a reduction in the U.S. price of imported merchandise for U.S. import duties before the domestic price is compared against the foreign price.
