Broadening 'Disability' — What Next?

Law360, New York (December 18, 2008, 12:00 AM EST) -- President Bush recently signed into law the Americans with Disabilities Act Amendments Act of 2008, which took effect Jan. 1, 2009.

The primary purpose of the Amendments is to broaden the meaning of “disability” and to extend the ADA’s protection to a much larger proportion of the workforce than was the case under the Supreme Court’s interpretations of the ADA in Toyota Motor Mfg. v. Williams (2002) and Sutton v. United Airlines Inc. (1999).
