Abbott Loses Bid To Erase $29M In Damages

By Ben James (December 29, 2008, 12:00 AM EST) -- Abbott Laboratories lost a bid to dodge a $29.2 million damages tab when the court overseeing a suit brought by Church & Dwight Co. Inc. against Abbott over three patents related to home pregnancy tests rejected Abbott's argument that the plaintiff wasn't entitled to damages because of the doctrine of laches.

Judge Garrett Brown Jr. of the U.S. District Court for the District of New Jersey issued a 20-page memorandum opinion on Dec. 23, writing that Abbott had failed to put forth sufficient evidence to show that C&D's delay in filing suit was unreasonable and inexcusable.
