Injunction In Fairchild Suit Stayed Over USPTO Ruling

Law360, New York (December 29, 2008, 12:00 AM EST) -- A federal judge has temporarily stayed an injunction against Fairchild Semiconductor International Inc. in a patent case with rival Power Integrations Inc. in light of conflicting positions between the court and the U.S. Patent and Trademark Office.

Judge Joseph J. Farnan Jr. of the U.S. District Court for the District of Delaware on Dec. 19 granted Fairchild a three-month stay to give the California chip maker time to petition a higher court for a permanent stay of the injunction pending appeal.
