Owens Corning ERISA Suit Dismissed

Law360, New York (December 30, 2008, 12:00 AM EST) -- A federal judge has tossed an Employee Retirement Income Security Act proposed class action against Owens Corning’s retirement savings plan, finding that it was barred by the statute of limitations.

Judge Jack Zouhary of U.S. District Court for the Northern District of Ohio, who refused to dismiss the suit in April, ruled Dec. 24 that an amended complaint filed by the plaintiffs and recent ERISA decisions convinced him that the plaintiffs knew everything they needed to know to file the suit in 2000, when Owens Corning...
