2nd Circ. Refuses To Review EPA Actions On NY Water

Law360, New York (December 31, 2008, 12:00 AM EST) -- A federal appeals court has denied a request from several towns that provide New York City's drinking water to review two enforcement actions by the U.S. Environmental Protection Agency regarding the towns' compliance with the Safe Drinking Water Act.

The U.S. Court of Appeals for the Second Circuit ruled Monday that the upstate New York towns of Hunter, Roxbury and Hamden did not show that a favorable court opinion could address the alleged harms they claimed in the suit.
