Stalling Safe Harbor Social Security No Match Suits

Law360 (January 5, 2009, 12:00 AM EST) -- On Dec. 8, 2008, U.S District Judge Charles R. Breyer of the Northern District of California denied motions filed by the Department of Homeland Security (DHS) to vacate the temporary injunction and speed up the proceedings in AFL-CIO v. Chertoff, NDCal, No 3:07-cv-04472-CRB), a lawsuit challenging the validity of regulations issued by DHS which would force employers to investigate and resolve social security mismatch notifications or face immigration consequences.
