Drug Cos. Not Liable For Meds Used In Meth: 8th Circ.

Law360 (January 6, 2009, 12:00 AM EST) -- An appeals court dealt a blow to Arkansas counties looking to hold pharmaceutical companies liable for the state’s methamphetamine epidemic, affirming Monday a lower court’s decision to dismiss the suit.

Judges William J. Riley, David R. Hansen and Michael J. Melloy of the U.S. Court of Appeals for the Eighth Circuit held that the manufacturers and distributors of over-the-counter cold and allergy medications — including Pfizer Inc. and Johnson & Johnson — were not liable for their products' eventual use in making methamphetamine.
