U.S. Steel FLSA Suit To Remain In Federal Court

Law360, New York (January 6, 2009, 12:00 AM EST) -- Finding that United States Steel Corp. adequately demonstrated that a wage-and-hour class action against it should proceed in district court, a federal judge has denied the lead plaintiff's request to remand the suit to a state court.

U.S. District Judge Ann D. Montgomery of the U.S. District Court for the District of Minnesota signed an order denying lead plaintiff John Zupancich's motion for remand Wednesday, finding that U.S. Steel had sufficiently asserted two grounds for federal jurisdiction: a federal question and diversity jurisdiction.
