Gilstrap Axes Patent Suit Over NPE's Cut-And-Paste Job

By Kelly Knaub (July 20, 2016, 11:52 PM EDT) -- Eastern District of Texas Judge Rodney Gilstrap has tossed an image transfer patent suit against Citizens National Bank after finding that nonpracticing entity Ruby Sands LLP not only failed to sufficiently allege infringement but also copied and pasted into the complaint unrelated text from another case.

The Cameron, Texas-based bank, unrelated to the well-known national chain Citizens Bank, had argued that Ruby Sands' allegations failed under the U.S. Supreme Court's landmark Twombly and Iqbal decisions, which require patent holders to demonstrate their claims are plausible.
