Court Tosses Magnesite Antitrust Suit

Law360, New York (January 7, 2009, 12:00 AM EST) -- A U.S. federal court has dismissed a proposed antitrust class action brought against a group of Chinese producers of the mineral magnesite for lack of subject matter jurisdiction.

Judge Garret E. Brown, Jr. of the U.S. District Court for the District of New Jersey also ruled that the plaintiffs, U.S. magnesite purchasers, had failed to state a claim upon which relief could be granted under the Sherman Act.
