Plaintiffs Fight Pilgrim's Pride Bid To Lift Stay

Law360 (January 8, 2009, 12:00 AM EST) -- Pilgrim's Pride Corp. is facing opposition to an attempt to lift the stay in its Chapter 11 case so it can pursue an appeal over whether plaintiffs are required to show an injury to competition when bringing claims under the Packers and Stockyards Act.

Three chicken farmers suing the company under the PSA objected Tuesday to the debtor's attempt to lift the stay, claiming that it would put them at a unfair advantage and prevent them from pursuing their own appeals in the case.
