Law360, New York (July 29, 2016, 4:33 PM EDT) -- The U.S. Patent Trial and Appeal Board has declined to take up a request from Priceline.com LLC, OpenTable Inc. and Kayak Software Corp. to review the validity of an IBM Corp. patent related to taking reservations online, saying the compnies failed to show the patent is obvious.
The PTAB on Wednesday shot down the challenge by the companies, which are owned by The Priceline Group Inc., finding IBM’s patent, which aids in continuous communication between internet users and servers, is dissimilar from other programs that achieve the same result.
