Claim Reinstated In Monster Backdating Suit

Law360 (January 12, 2009, 12:00 AM EST) -- A judge has reinstated a claim of securities fraud against former Monster Worldwide Inc. executive James J. Treacy in a criminal suit over stock options backdating, despite Treacy’s contentions that the count is time-barred and potentially violates the double jeopardy clause of the Fifth Amendment.

Judge Robert L. Carter issued the ruling Thursday in the U.S. District Court for the Southern District of New York, reinstating the claim after finding that the statute-of-limitations calculation used to dismiss the claim was incorrect.
