10th Circ. Orders Wrongfully Fired Truck Driver Rehired

By Vin Gurrieri (August 8, 2016, 6:32 PM EDT) -- The Tenth Circuit ruled Monday that a trucking company must rehire an employee it fired for abandoning cargo after being told to work in unsafe conditions, saying his actions were protected activity.

In a published opinion, the Tenth Circuit held that TransAm Trucking Inc. illegally fired truck driver Alphonse Maddin for leaving his cargo on the side of the road after waiting hours in an unheated truck for a repair crew even though his supervisor had told him to either stay put or drag the trailer with its frozen brakes.
