Gas Royalty Payment Class Action Against XTO Is Tossed

Law360, New York (August 11, 2016, 4:08 PM EDT) -- A Kansas federal judge on Wednesday tossed a proposed class action against XTO Energy Inc. brought by a group of natural gas royalty owners who claimed the company improperly deducted processing expenses from their payments, but allowed the parties to refile the case in the future.

The Wallace B. Roderick Revocable Living Trust — the lead plaintiff in the case — made an unopposed motion Tuesday asking U.S. District Judge Eric F. Melgren to dismiss the case, a move that came about a month after the judge denied certification to the royalty owners because the trust hadn't adequately shown enough commonality...
