Volvo Dealer Bonus Program Not Discriminatory, Judge Rules

Law360, New York (August 25, 2016, 6:42 PM EDT) -- An Ohio federal judge ruled Thursday that Volvo’s North American division made its dealer incentive program available to all of its franchises, rejecting a suburban Columbus dealership’s claims that Volvo implemented a discriminatory pricing scheme by unevenly paying bonuses to different dealerships.

Smith granted summary judgment to Volvo Cars of North America LLC, finding that the automaker made its so-called facility investment initiative, or FII —  a program offering bonus payouts to dealers whose facilities meet certain branding and design standards verified by Volvo — “functionally available” to all of its dealerships and did not implement...
