Coca-Cola Sued Over Diet Coke Plus Labeling

Law360, New York (January 16, 2009, 12:00 AM EST) -- Coca-Cola Co. has been slapped with a proposed class action for marketing Diet Coke Plus as a healthy soft drink, days after a similar lawsuit was filed against the beverage conglomerate over its VitaminWater drink.

Consumers Thomas Mason and Molly E. Adams filed a complaint in the U.S. District Court of New Jersey on Wednesday after the U.S. Food and Drug Administration proclaimed that labeling on Diet Coke Plus misleads consumers to believe that the beverage provides extra nutritional benefits.
