Judge Sends IBC, BCS Legal Fee Spat To Arbitration

Law360, New York (January 16, 2009, 12:00 AM EST) -- BCS Insurance Co. has won its petition to compel arbitration of a bad faith claim brought by health insurer Independence Blue Cross to recover more than $7 million in legal fees IBC forked over in defending its executives in a contract spat.

On Thursday, Judge Charles Kocoras of the U.S. District Court for the Northern District of Illinois granted the Chicago-based insurance company's bid to remove the coverage dispute from court, saying the policy BCS issued to IBC bound the parties to arbitration.
