Pa. Poultry Workers' Donning, Doffing Suit Revived

Law360 (January 20, 2009, 12:00 AM EST) -- A Pennsylvania appeals court has breathed new life into a class action brought by former employees of Farmers Pride Inc., saying the workers had a right under state law to sue for time spent donning and doffing safety gear.

In an order handed down Thursday, the Superior Court of Pennsylvania reversed a ruling by a state judge that effectively terminated the wage-and-hour suit by workers at Farmers Pride's chicken processing plant in Fredericksburg, Pa.
