NJ Court Revives Celanese Suit Over Site Cleanup

Law360, New York (January 20, 2009, 12:00 AM EST) -- A New Jersey appellate court has revived a suit brought by Celanese Ltd. alleging the Essex County Improvement Authority is liable for contamination from a site that the industrial chemical maker sold to the county.

On Friday, the Superior Court of New Jersey, Appellate Division, reversed a lower court's decision to dismiss the Celanese suit, finding that it had wrongfully attempted to resolve ambiguity in a sales contract between Celanese and the Improvement Authority.
