EU High Court Upsets Employers On Annual Leave

Law360, New York (January 20, 2009, 12:00 AM EST) -- In a setback for European employers, the top court in the European Union has ruled that workers are still entitled to the paid annual leave they have accrued even if they fall ill.

On Tuesday, the European Court of Justice ruled as part of its interpretation of the so-called working time directive that employees do not forfeit their entitlement to annual leave just because they are on sick leave.
