11th Circ. Won't Rehear Blocked Relief For Overlong Detention

Law360, New York (September 14, 2016, 2:14 PM EDT) -- The Eleventh Circuit refused Tuesday to rehear en banc its decision that Congress did not provide any avenue for an unauthorized immigrant to seek monetary relief for being detained longer than the 90-day statutory period for removal.

The three-judge panel that had issued the March 24 decision denied Cuban native Santiago Alvarez’s petition for rehearing and petition for rehearing en banc in a brief, one-page order Tuesday. No accompanying opinion was issued, as is customary.
