Part Of Varian Semiconductor Patent Invalid: Judge

Law360, New York (January 22, 2009, 12:00 AM EST) -- A federal judge has ruled that some claims of a reissue patent for semiconductor technology held by Varian Semiconductor Equipment Associates Inc. are invalid because they do not describe the same invention as the original patent.

Wednesday's ruling by Judge Douglas P. Woodlock of the U.S. District Court for the District of Massachusetts came in response to a motion for summary judgment of invalidity by Axcelis Technologies Inc., which Varian has accused of infringing the patent-at-issue.
