4th Circ. Reverses On ERISA Limitations Finding

Law360 (January 22, 2009, 12:00 AM EST) -- A federal appeals court on Wednesday vacated and remanded a case involving a former Tupperware U.S. Inc. employee seeking long-term disability coverage from the Prudential Insurance Co. of America, holding that the district court erred when invoking a one-year statute of limitations and dismissing an Employee Retirement Income Security Act complaint as time-barred.
