Chemguard Tries To Snuff Firefighting Foam Claims

Law360 (January 23, 2009, 12:00 AM EST) -- Chemical manufacturer Chemguard Ltd. has moved to dismiss unfair competition claims in a product liability declaratory judgment suit brought by rival Dynax Corp. over chemicals found in fire-extinguishing foams used by firefighters.

Chemguard filed a motion for partial summary judgment Thursday in the U.S. District Court for the Southern District of New York, disputing Dynax's allegations of false commercial advertising and claiming it cannot be held liable for any breach of the Lanham Act.
