Ex-Weil Assoc. Wins Attorneys' Fees In ERISA Spat

Law360, New York (January 26, 2009, 12:00 AM EST) -- The U.S. Court of Appeals for the Second Circuit has ruled that a former Weil Gotshal & Manges LLP associate who successfully sued First Unum Life Insurance Co., the firm's long-term disability income plan administrator, for terminating his benefits did not need to prove bad faith to win attorneys' fees and prejudgment interest.

On Friday the federal appeals court overturned the district judge's ruling finding that First Unum hadn't acted in bad faith or with enough culpability to merit attorneys' fees for plaintiff Zbigniew Slupinski....
