Wal-Mart Loses Rehearing Bid Over Fire Liability

Law360 (January 27, 2009, 12:00 AM EST) -- A wrongful death product liability suit against Wal-Mart Stores Inc. is back on track as a Texas appeals court won't reconsider its decision to revive allegations a defective Wal-Mart lamp caused a fatal house fire.

On Friday, Justice Jack Carter of the Court of Appeals for the Sixth Appellate District of Texas denied Wal-Mart’s bid for a rehearing and reiterated the court’s order for the trial court to vacate its summary judgment ruling and carry on with the product liability suit.
