Strikers Entitled To Unemployment: NJ High Court

Law360, New York (January 27, 2009, 12:00 AM EST) -- Affirming a state law, New Jersey’s high court has ruled that nurses striking from a hospital were entitled to unemployment benefits because their workplace remained open during a labor dispute.

In a 6-1 ruling on Tuesday, the New Jersey Supreme Court reversed a lower court’s decision that found the nurses were ineligible for benefits.

Scheduling and financial disputes prompted 240 registered nurses from Willingboro, N.J.-based Lourdes Medical Center to take to the picket line in April 2004, and 97 of those nurses lodged unemployment claims during...
