Goody's Stung With WARN Class Action

Law360 (January 28, 2009, 12:00 AM EST) -- The path to liquidation for Goody’s LLC got rockier Tuesday as a former employee fired off a putative class action for pay and benefits, claiming the fallen retailer failed to give its workers ample notice of the mass layoffs.

The complaint, filed in the U.S. Bankruptcy Court for the District of Delaware, claims Goody’s, which entered bankruptcy protection earlier this month for the second time in six months, violated the provisions of the Worker Adjustment and Retraining Notification Act when it abruptly axed its workers....
