Law360, New York (October 14, 2016, 5:17 PM EDT) -- The U.S. Equal Employment Opportunity Commission on Thursday said it will appeal to the Sixth Circuit a ruling that a funeral home's firing of a transgender employee was protected under the Religious Freedom Restoration Act.
The agency is appealing U.S. District Judge Sean F. Cox's August dismissal of a transgender former employee's wrongful termination claim against R.G. & G.R. Harris Funeral Homes Inc. on the grounds that its dress code was protected under the RFRA as religion based.
