Judge Allows Prosthetic Sleeve Patent Suit To Go On

Law360 (February 3, 2009, 12:00 AM EST) -- A federal judge has refused to toss out a declaratory judgment suit by Daw Industries Inc. claiming that a patent for prosthetic device sleeves held by Proteor SA is invalid and that Proteor's assertion of the patent violates antitrust laws.

Judge Michael Anello of the U.S. District Court for the Southern District of California on Tuesday denied a summary judgment motion by Proteor claiming that Daw released all claims against Proteor when the two companies settled an earlier state court lawsuit over distribution agreements.
