EPDM Seeks Support In Peroxide, Plastics Rulings

Law360, New York (February 4, 2009, 12:00 AM EST) -- A defendant in the long-running multidistrict litigation over alleged price-fixing in the ethylene propylene market is arguing that two recent appellate court decisions on class certification in antitrust cases bolster its own case against class certification.

DSM Copolymer Inc. filed a notice on Tuesday in the U.S. District Court for the District of Connecticut pointing to recent decisions by the U.S. Court of Appeals for the Third Circuit in two similar price-fixing cases — one over hydrogen peroxide and one over plastics additives.
