Abbott Denied Stay In Cordis Stent Spat

Law360, New York (February 4, 2009, 12:00 AM EST) -- A federal judge has refused to grant Abbott Laboratories’ request to stay an ongoing lawsuit while the U.S. Patent and Trademark Office re-examines four stent patents owned by Johnson & Johnson subsidiary Cordis Corp.

Abbott filed a motion to stay the proceedings pending the outcome of the inter partes examinations, but Judge Joel Pisano denied the motion on Tuesday in the U.S. District Court for the District of New Jersey, saying the stay would unfairly prejudice Cordis, who has argued that Abbott’s product has already affected...
